NYC printing 123's TERMS AND CONDITIONS
PLEASE READ THESE TERMS & CONDITIONS CAREFULLY.
We reserve the right to refuse service at any point without disclosing a reason. All prices are subject to change.
LEGAL CLAIM
BY ACCESSING & USING ANY OF OUR SERVICES, YOU AGREE TO BE BOUND BY THE TERMS & CONDITIONS STATED BELOW.
NYC printing 123 RESERVES THE RIGHT TO CHANGE, MODIFY OR AMEND THESE TERMS AND CONDITIONS WITHOUT ANY NOTICE.
ORDERS
Any order placed after 3pm will go into print the following day and the print ready time will start counting as of the next business day.
Any changes to Orders must be done in writing via email or mail.
We do not accept PO's. Orders can only be submitted and deemed valid once directly receiving a order confirmation,
we will not extract any information requirements or specs from a PO, email or Document.
Payment must be submitted in full prior to artwork proofing any work or preparation done to the files.
Orders left or returned to our premises without any communication will be recycled and disposed of within 14 days of completion.
Once an order is completed it is the customer's responsibility to check on his order and to pick up, No notification is sent out once an order is completed.
Orders picked up or taken in full or partially without signing your delivery/pickup confirmation release will not be allowed to be returned/reprinted or refunded,
and will automatically approve the order pick up as "flawless" and waive any rights to chargeback/returned/reprinted or refund the order.
LOGISTICS
Any order picked up the same day it is ready can be picked up between 8am and 8pm but each location's hours of operation vary.
At times some orders can be ready after a location is closed, in such case,
we will contact the customer 1/2 in advanced before the order is ready to let them know that a staff member will be at the pick-up location at the estimated time and will wait 15 minutes after the estimated time,
Therefore giving a customer 45 minutes total time to pick up their order. Orders not picked up cannot be refunded/reprinted or credited.
It is the customer’s duty to stay check on the status on their order, follow up and pick up the order.
We will not contact the customer to pick up any orders unless the order is ready past the location's closing time.
Delivery for orders cannot be time guaranteed. We can only guarantee delivery for orders between 11am to 11pm.
It is the customer’s responsibility to pick up or sign the delivery/pickup confirmation release form personally since the customer must inspect and revise the product directly.
We are not held responsible for 3rd party individuals (receptionists, co-workers, friends, family, assistants, etc.) signing off on a package.
ORDER SHIPPING AND DELIVERY
NYC media 123 - NYC printing 123 will always act to make sure that any production difficulties do not delay delivery schedules.
In no case shall NYC media 123 - NYC printing 123 be liable for any consequential or damages resulting from any delay in shipment or delivery.
RUSH ORDERS
Rush orders cannot be cancelled for any reason or circumstance.
RUSH ORDER REQUIREMENTS
Orders with artwork not provided before 3pm will not start until the following business day.
Orders for which artwork not provided art is not entitled to any refund regardless situation.
Special requirements (1 color napkins, shirts screen printed, hats, napkins)
Minimum line size shall be of 10 pixels at 300dpi
Minimum font size must be comparable to 18pt Arial bold at 300dpi
IMPERFECTIONS & FLAWS
Due to the nature of our Rush printing and expedited printing methods products tend to have minor imperfections and flaws listed below.
Paper printing products deviations, shifting and cutting can be of up to .25" in any direction.
Napkin printing deviations and shifting can be of up to 10 degrees and up to .5" in any direction.
Screen printing (shirts, aprons, tote bags, etc.) deviations and shifting can be of up to 20 degrees and up to 2" left to right and top to bottom of up to 5".
FILES REPARATION
We will not refund any order not having the correct artwork preparation and bleed on our file preparation page.
If artwork or files do not have the correct specifications we will not be responsible for editing or making the files, digital or print ready.
ORDER APPROVAL
Orders that are not approved within 72 hours by the client or without communication on behalf of the client, will be auto approved and put into print.
CUSTOMER SUBMITTED ARTWORK OR GRAPHICS
All artwork or designs and images must be provided in CMYK format.
We are not responsible for any color shift that occurs in conversions from RGB to CMYK color modes.
All artwork, designs and images must be provided in minimum of 300 DPI and CMYK color mode with a correct bleed.
PROOFING & MATCHING
Hard Copy proofs are not refundable under any situation.
Proofs are not a default in any situation, and can be provided at nyc printing 123's discretion on a case by case basis.
An order can take up to 72 hours for proof to be sent based on customers’ artwork. Orders will not be color matched or printed with any specific color density,
if your order requires specific colors/tones/shades/orientation do not send your order as we cannot guarantee any specific colors/tones/shades.
We are not liable for color matching or ink density on screen proofs approved by the customers.
Screen proofs will predict approximate (not exact) layout, text content, image proportion and placement, but not color or density.
Standard Design and Onsite design do not include any color matching.
If the customer does not request a proof at time of ordering, customer agrees to the final product based on verbal or written description provided to nyc printing 123 and its representatives at time of order.
LIMITATION OF LIABILITY & INDEMNITY
In no event shall NYC printing 123 or its licensors, suppliers, or vendors, their officers, owners, directors, employees, or agents,
be liable for any special, incidental, indirect, or consequential damages of any kind, or for any damages whatsoever
resulting from loss of use, data and profits or cancellations whether or not we have been advised of possibility of the damage.
ORDER CANCELLATION
A cancellation charge applies to ALL orders placed regardless of stage or progress
[17% before proof is sent out and 27% after proof has been sent] as long as the order has not gone into print.
NYC media 123 - NYC printing 123 will be happy to help you cancel your order prior to Approval but orders cannot be edited, switched or cancelled after approval.
Orders may be eligible for cancellation upon request via email only as long as they are not Rush Orders.
Our Customer Service Team will inform you of any cancellation charges depending on the stage of the order.
RUSH ORDERS WILL NOT BE CANCELLED for any reason, even 5 minutes after order has been processed due to many factors which allow us to process your order in a expedited manner.
If job is canceled any labor hours (proof, graphics design, etc.) or administrative fees (credit cards fees, etc.) will be subtracted from your refund. Minimum is $15 ( 15%-99% of total transaction )
Once the order has been placed successfully, No Refunds are issued for the Logo, color match, proofs and Graphic design services.
RETURNS, REFUNDS and MANAGEMENT
Please send an email to management to management@nycprinting123.com in subject put att: management,
the reason to this is being a web based company everything must be done in writing to ensure a recorded track history for order inquiries, problem orders, or price quotes.
Management response time is normally 1-7 business days but is not guaranteed for that time range.
Damaged products that are not returned entirely cannot be subject to reprint credit or refund.
Since each order is unique to customer and has no re-sale value, All Sales Are Final. If any order is partially picked up we do not provide refunds or exchanges.
If we verify that we made an error, we will re-print the order. No Refunds or Credit or exchanges.
RETURNS
Customer must notify us within 3 business days of order acceptance to declare any defects in the ordered product.
In order to receive replacement Customer must return 100% of the received product within 5 days (on their own expense) from the time when the ordered product delivery was taken.
All charges related to expedite printing (Rush Printing or Shipping) are NOT REFUNDABLE, including for those orders that are returned for any reason. All orders that are being returned must be shipped by customer's own expense.
SHIPPING
Lost or damaged claims can only be filed for shipments over $20.00 in value and can only be done after 30 days from package shipment.
We are not responsible for 3rd party (UPS, FEDEX, DHL, and MESSENGERS) shipping errors, omissions or damaged shipments.
CREDIT CARDS
Order exceeding $600 or greater may require an authorization form and copy of credit card and state ID license, or payment via check or wire transfer.
